United States v Nixon
When Richard Nixon was involved in legal trouble following the Watergate Scandal, the prosecution subpoenaed for certain audio clips and evidence that would prove Nixon’s guilt. Nixon attempted to use his power in office to justify withholding evidence, with his own attorney stating that “I don’t represent Mr. Nixon personally. I represent him in his capacity as president.” Finally, Nixon claimed executive privilege (gives government branches confidentiality) in order to bypass the requirement of submitting clearly incriminating evidence.
Breakdown Verdict.
A unanimous decision was reached against Nixon a day after the oral arguments concluded. The Court determined that executive privilege had a main purpose of national security, such as when a secret could compromise the safety of the people. This verdict exemplifies that all citizens, including the president, must follow the rule of the law. He will be given the same individual liberties and will face the same trial process.
Result Going Forward.
United States v Nixon accounts for the separation of powers, and where the president crossed the line between exercising power and overstepping into another branch’s jurisdiction. The president will always hold the power to lead the nation, however his power does not constitute a higher standing in the law.
