Actions against age
The Free Speech Coalition filed a lawsuit against Texas Attorney General Ken Paxton for Texas House Bill 1181. This bill stated that websites holding a “substantial portion” of sexual content needs verification that users are 18 or older with official identification. Bill 1181 also reads that there must be warnings on the website about the dangers of pornography. The central problem was that having such a specific need for identification can expose users as well as forcing websites to place warnings on their website.
Breakdown Verdict.
The verdict of the lower court was reversed (6-3), claiming verification is constitutional (consistent with rules of the Constitution) regardless of how it inconveniences adult users. However, they did not support the idea of warning users of potential consequences of being on the website, as they believed it went against free speech rights.
Result Going Forward.
Age verification becomes a conflict of interest now, since the ethical standpoint of safety, whether it is through anonymity vs verification, continues to hold a different meaning for separate organizations. The government supports identification because it lowers the rate of sexual crimes and illegal access, while businesses would support anonymity for a higher amount of users.
